General Terms and Conditions

1. preamble
By registering as a user with pinnery, you accept the General Terms and Conditions for the use of pinnery (GTC), which are as follows:

pinnery GmbH, Am Fischweg 17, 92256 Hahnbach (provider) operates the online software (app) meetingnotes under various domains on the Internet. These services are hereinafter referred to as "meetingnotes". These GTC govern the contractual relationship between the user of meetingnotes and the provider, irrespective of the website on which the user registers for meetingnotesand the domain through which the useraccesses it .These GTC can be accessed, downloaded, printed and savedatany time via the website of meetingnotes ,even after the conclusion of the contract.


2. subject
meetingnotes is an online software (cloud software) for handwritten notes, which can be used to support team meetings or meetings. The app can be downloaded via the browser or in the respective app store (Apple Store or Google Play Store).Via a registration form, the user can first create a free account in orderto then share and retrieve his or her notes online. The provider grants the user free access here .If required, the user can receive certain additional services for a monthly fee . Theprices for these services are announced on the meetingnoteswebsite and are binding.

Any use of meetingnotes other than through the facilities offered on the meetingnotes website requires the prior written consent of the provider.

The provider makes the data/information provided by the user available to other users only insofar as this data/information does not violate legal regulations or these GTC. The provider may remove illegal content from the meetingnotes-Websites without prior notice. The user acknowledges that a 100% availability of meetingnotes is technically not feasible. However, the provider endeavours to keep meetingnotes available as constantly as possible. In particular, maintenance, capacity and security concerns, as well as events beyond the control of the provider (such as disruptions in the communication networks, power outages, etc.) may lead to short-term disruptions or to the
temporary suspension of meetingnotes.

3. registration

The user must register on the meetingnotes website before using meetingnotes.The user warrants that all data provided during registration are complete and true. In the event of changes to his user data , the user undertakes tonotify the provider immediately . The user undertakesto keep secret the password to be chosen during registration. The provider will not disclose the password to third parties and will only request the password via the meetingnotes web pages for the purpose of registration (login) .

By registering with meetingnotes, the user makes a declaration of intent to use meetingnotes, which is accepted by the provider by enabling the user to use meetingnotes. Through this activation, the contract between the user and the provider is concluded. The software meetingnotes allows the user to designate third parties who will also have access to his area at meetingnotes. These are additional users whocan be activated to view the user's data . Inthis way, the user can grant his employees and his tax advisor the necessary access thatsuch softwareentails.

4. revocation
If the user registers with meetingnotes exclusively for the purpose of private use, the following conditions apply to him as a consumer in the sense of the law:
The user may revoke the registration for the use of meetingnotes in text form within 2 weeks without giving reasons. The period begins with the activation of meetingnotes by the provider, at the earliest, however, after receipt of these GTC. The timely dispatch of the revocation is sufficient to comply with the revocation period. The revocation can be sent to pinnery GmbH, Am Fischweg 17, 92256 Hahnbach, Germany.
In the event of a revocation of a paid membership, the services received by both parties must be returned within the scope of the statutory provisions and any benefits derived, such as interest, must be surrendered. If the received
services cannot be returned or can only be returned in part or in a deteriorated condition, compensation must be paid.

5 Duties of the user
When using meetingnotes, applicable law and all rights of third parties must be observed. In particular, the user is prohibited from using insulting, defamatory content, regardless of whether this content concerns other users, employees of the provider
or other persons or companies. The use of mechanisms, software or scripts in connection with meetingnotes is prohibited, unless this is explicitly based on documented interfaces provided by the provider. Blocking, overwriting, modifying and copying content of meetingnotes, unless this is necessary for the proper use of meetingnotes.
Any action that is likely to impair the functionality of meetingnotes, in particular to place an excessive load on it beyond normal use, is prohibited. When using meetingnotes, the user documentation (help) must be observed, the latest version of which is availableon the Internet at

6. changes
The provider reserves the right to change the services offered at meetingnotes or to offer different services, provided that this is reasonable for the user.

7. termination of contract
The user may terminate the free membership at any time without giving reasons. The termination can be done by the means offered at meetingnotes (delete account). The user may terminate the paid membership at any time without giving reasons with a notice period of 14 working days. Payments already made for 12 months in advance at
will not be refunded. Upon termination of the contract, the user must ensure that he/she backs up his/her content uploaded or entered at meetingnotes
so that he/she does not suffer any damage as soon as he/she no longer has access to the meetingnotes services. After termination of the contract, the provider is not obliged to make data available to the user at
that the user has made available during his period of use at meetingnotes.

8 Responsibility for content & data
The provider assumes no responsibility for the content, data and/or other information uploaded or entered by users at meetingnotes, nor for content on externally linked websites. In particular, the provider does not warrant that such content is true, serves a particular purpose or can serve such a purpose.
Should the user notice any use of meetingnotes that is contrary to the law or to the contract, he may report this at any time via the e-mail address provided on the meetingnotes website. 

9 Liability and damages Claims for damages, irrespective of the reason, against the provider (including its vicarious agents), which presuppose slight negligence, only exist if an essential contractual obligation/cardinal obligation has been breached. In this case, claims for damages are limited to the amount of the typical foreseeable damage.

10.Final Provisions Amendments to this contract must be made in writing. Subsidiary agreements do not exist. The provider reserves the right to change these GTC at any time without stating reasons, provided that this is reasonable for the user. The provider will inform the user of the changes to the GTC in good time. If the user does not object to the validity of the new GTC within 2 weeks, they shall be deemed accepted by the user. Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. Rather, the contracting parties undertake to replace an invalid provision with a valid provision that comes as close as possible to the economically intended meaning and purpose of the original provision. The same shall apply in the event of contractual loopholes.

The place of performance is the registered office of the provider. The place of jurisdiction is, as far as legally permissible, the registered office of the provider.

German law shall apply.
